1. Acceptance of Terms

By accessing or using FollowUp Pro (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms constitute a legally binding agreement between you and FollowUp Pro ("we", "our", "us"). We may update these Terms from time to time, and your continued use of the Service constitutes acceptance of any modifications.

2. Description of Service

FollowUp Pro is an automated email follow-up service that integrates with Gmail through the Google API. The Service allows you to:

• Schedule and send automated follow-up emails from your Gmail account.
• Create and manage email templates with dynamic variables.
• Automatically detect replies and stop follow-up sequences.
• Label and organize Gmail threads with active follow-ups.
• Log follow-up activity to Google Sheets for tracking purposes.

3. Account & Authentication

To use the Service, you must:

• Have a valid Google account with Gmail access.
• Authorize FollowUp Pro to access your Gmail and Google Sheets accounts via OAuth 2.0.
• Maintain the security of your Google account credentials.

You are responsible for all activity that occurs under your account. You must notify us immediately if you suspect any unauthorized use of your account or any security breach.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in compliance with all applicable laws and regulations. You must not use the Service to:

• Send spam: Unsolicited bulk emails, junk mail, or any messages that violate the CAN-SPAM Act, GDPR, or similar regulations.
• Harass or threaten: Send abusive, threatening, defamatory, or harassing communications.
• Distribute malware: Send emails containing viruses, malware, or other harmful content.
• Impersonate others: Misrepresent your identity or affiliation with any person or organization.
• Violate Google's terms: Use the Service in any manner that violates Google's Terms of Service or API Services User Data Policy.
• Circumvent limits: Attempt to bypass rate limits, sending quotas, or other restrictions imposed by the Service or Gmail.

5. Sending Limits & Fair Use

The Service enforces sending limits to protect your Gmail account and ensure deliverability:

• Daily sending limits are configurable but capped to stay within Gmail's API quotas.
• Maximum follow-up attempts per thread are enforced to prevent excessive sending.
• We reserve the right to throttle or suspend accounts that engage in abusive sending patterns.

You acknowledge that Gmail's own sending limits and policies apply in addition to our Service limits.

6. Intellectual Property

The Service, including its design, code, features, and documentation, is owned by FollowUp Pro and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.

You retain ownership of all content you create using the Service, including email templates and configurations.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose.
• Warranties that the Service will be uninterrupted, error-free, or secure.
• Warranties regarding the accuracy or reliability of emails sent through the Service.
• Warranties regarding email deliverability or inbox placement.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOLLOWUP PRO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, goodwill, or business opportunities.
• Damage to your reputation arising from emails sent through the Service.
• Gmail account suspension or restrictions resulting from your use of the Service.
• Any unauthorized access to your data due to factors beyond our reasonable control.

Our total aggregate liability for any claims arising from your use of the Service shall not exceed the amount you paid us (if any) in the twelve (12) months preceding the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless FollowUp Pro and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service.
• Your violation of these Terms.
• Your violation of any applicable law or regulation.
• The content of any emails you send through the Service.

10. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Reasons for termination may include:

• Violation of these Terms or our Acceptable Use policy.
• Abusive sending patterns or spam complaints.
• Prolonged inactivity.
• Requests by law enforcement or other government agencies.

You may terminate your use of the Service at any time by revoking OAuth access through your Google Account settings.

11. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration or in the courts of competent jurisdiction.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.
